Terms and conditions

These terms and conditions of use apply to the Oak Curriculum API (referred to as our API), which includes the following: https://open-api.thenational.academy/ and https://open-api.thenational.academy/playground

These terms and conditions apply to our services, including use of an API key, which we supply to you, upon request.

If you continue to browse or use our website and/or use any of our services, you are agreeing to comply with and be bound by the following terms and conditions of use.

The terms “Oak”, “us” and “we” refer to the owner of the website, Oak National Academy Limited. The term “you” refers to the user or viewer of our website or user of any of our services.

The use of these websites and any of our services is subject to the following terms and conditions, which we can update at any time without notice:

Definitions

API: the Oak Curriculum API application programming interface, the API Documentation, and any other related API materials made available by Oak including, but not limited, through its Oak Curriculum API as each may be updated from time to time;

API Data: all data published or made available through the API, along with any related metadata;

API Documentation: means the API documentation made available by Oak;

API Key: the security key Oak makes available for you to access the API;

Intellectual Property Rights: patents, utility models, rights to inventions, copyright and related rights, trade marks and service marks, trade names and domain names, rights in get-up, goodwill and the right to sue for passing off or unfair competition, rights in designs, rights in computer software, database rights, rights to preserve the confidentiality of information (including know-how and trade secrets) and any other intellectual property rights, including all applications for (and rights to apply for and be granted), renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist, now or in the future, in any part of the world.

Linked Platforms: websites other than Oak’s, blogs and social media platforms, links to which are found on our website.

Oak Curriculum API: includes the following: https://open-api.thenational.academy/ and https://open-api.thenational.academy/playground

OGL: Open Government Licence v3.0;

Services: collectively the API and API Key;

Third Party Content: digital assets, such as but not limited to, software, images, videos, available to Oak under the OGL;

Use: copy, publish, distribute, transmit, adapt, exploit the content commercially and non-commercially for example, but not limited, by combining it with other information, or by including it in your own product or application;

Virus: any thing or device (including any software, code, file or program) which may: prevent, impair or otherwise adversely affect the operation of any computer software, hardware or network, any telecommunications service, equipment or network or any other service or device; prevent, impair or otherwise adversely affect access to or the operation of any program or data, including the reliability of any program or data (whether by re-arranging, altering or erasing the program or data in whole or part or otherwise); or adversely affect the user experience, including worms, trojan horses, viruses and other similar things or devices.

1. Using our website

We are continually striving to improve our website and services, which are being updated all the time. We can change or remove content at any time without notice.

You agree:

  • to use our website and Services for lawful purposes only;
  • to use our website and Services in a way which does not infringe the rights of, or restrict or inhibit the use and enjoyment of them by anyone else;
  • not to engage in any malicious activities, when using our website and Services, including but not limited to:
    • unauthorised access to the website’s systems and data or Services;
    • distribution of malware, Viruses or any other malicious code;
    • attempting to disrupt or impair the functionality or availability of the website and Services;
    • engaging in any activities which violate the privacy or security of users of the website and API;
    • engaging in any activities which attempt to manipulate the website, API or API Data or any interactive products provided on it or any of our Services to create, disseminate, or promote inappropriate, harmful, or malicious content and/or mis-information.

We own all rights, title, and interest in and to the website and the Services offered except where expressly stated otherwise.

We may remotely monitor and audit your use of the API and the API Data to ensure you complying with these terms and conditions and you hereby consent to such monitoring and auditing, including the use of any remote monitoring tools by us for this purpose. We reserve the right to remove or modify your rights to use this website and our Services if your use does not comply with these terms and conditions.

2. Using lesson content from our API

Our API provides a collection of lesson content consisting of digital materials, including, but not limited to:

  • quizzes;
  • slide decks;
  • worksheets;
  • audio and video content and any transcripts thereof and any transcripts materials or tools utilised therein (including any subtitling, captioning, sign language or other methods adopted to enable access);
  • any additional materials provided to assist with teaching a particular lesson.

This lesson content, which is hosted in our OpenAPI (https://open-api.thenational.academy/) is made available to use under OGL, except where otherwise stated.

Third party content used in slide decks and worksheets have been audited to identify copyright licensing requirements. Lessons in the API contain assets that are either owned by Oak or are third party assets under an OGL compatible licence. Third party software is being continuously updated.

Oak has no responsibility to notify you of changes to the API or request further approvals from you with the exception of major changes to the API.

Subject to the disclaimers provided in section 5 of these Terms and Conditions, this means that you are free to use it in the following ways (referred to as “use” below):

  • copy, publish, distribute and transmit the content;
  • adapt the content;
  • exploit the content commercially and non-commercially for example, by combining it with other information, or by including it in your own product or application.

When using content subject to OGL you must:

  • Attribute Oak National Academy using the following statement: “A [subject – English etc] lesson by Oak National Academy licensed under Open Government Licence (OGL)”;
  • Provide a link to the terms of the OGL licence: https://www.nationalarchives.gov.uk/doc/open-government-licence/version/3/
  • Ensure that your use of any third party asset is compatible with the terms of the licence as stated on that individual asset (for example, by ensuring the asset is attributed correctly).

You must not:

  • sub-license, assign or novate the benefit or burden of the agreement pursuant to these Terms and Conditions in whole or in part;
  • allow the API or API Data to become the subject of any charge, lien or encumbrance;
  • deal in any other manner with any or all of its rights and obligations under these Terms and Conditions, without our prior written consent, such consent not to be unreasonably withheld or delayed.

3. Links from our website

From time to time, this website may also include links (“linked platforms”). We provide these links for your convenience. They do not signify that we endorse these linked platforms, and we accept no responsibility for:

  • the content of the linked platforms;
  • the protection of any information you give to the linked platforms;
  • any loss or damage that may arise from your use of these linked platforms or any additional platforms they link to.

You should read all terms and conditions, privacy policies and End User licences which relate to these linked platforms before you use them.

4. Links to our website

Whilst we welcome you linking your own website or organisation to this website (or providing a link to this website in your documentation), you must NOT:

  • say your organisation or website is associated with or endorsed by us;
  • unless the content is available under OGL and no further restrictions apply, license, sell, rent, lease, assign, charge for access or use of or otherwise commercially exploit any lessons or other products which appear on our website. Please see our Guide to website licensing for assistance.

5. Disclaimers for our website and services

The contents of the pages of this website and the API are for your general information and use only.

The API and API Data is licensed “as is” and we exclude all representations, warranties, obligations and liabilities in relation to the information to the maximum extent permitted by law.

Whilst we make every effort to ensure the content of our website and our Services is:

  • current;
  • available to use under OGL or an OGL compatible licence;
  • secure;
  • accurate;
  • complete; and
  • free from bugs or Viruses;

neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website and provided in our Services for any particular purpose. You acknowledge that such information and materials may contain inaccuracies, errors and/or contain content which is not OGL compliant (for example, the use of content which is owned by third parties and/or trademarks). We expressly exclude liability for any such inaccuracies or errors, and we shall not be liable for any loss, injury or damage of any kind caused by its use.

We make every effort to check and test our website for Viruses at every stage of production.

9. Governing law and disputes

These terms and conditions are governed by and construed in accordance with the laws of England and Wales.

Any dispute relating to these terms and conditions, or your use of our website (whether it be contractual or non-contractual) will be subject to the exclusive jurisdiction of the courts of England and Wales.

We are not liable if we fail to comply with these terms and conditions because of circumstances beyond our control.

We may decide not to exercise or enforce any right available to us under these terms and conditions. We may decide to exercise or enforce that right at a later date. Doing this once does not mean that we automatically waive the right on any other occasion.
